Answer

Section 15 of the Official Information Act 1982 sets out the circumstances when it is appropriate for an agency or ministerial office to charge for the supply of official information. My office, and agencies for which I am responsible for, are guided by the Ombudsman’s guidance which outlines the principles and applicability of charging for the supply of official information, including activities that can and cannot be charged for: https://www.ombudsman.parliament.nz/resources/charging-guide-charging-official-information-under-oia-and-lgoima. Charging under the Official Information Act 1982 is only appropriate when a decision has been made to release information, and only to recover reasonable costs for its supply. The requester must also agree to the proposed charge.
