Further to the reply to written question 37231 (2026), which rules of the Government Procurement Rules were relied on in taking decisions for exemptions, on how many occasions has each been relied on since 1 April 2025, and where in the Rules does "a fair basis" appear as a ground for exemption?
Answered by
Rt Hon Winston Peters
List MP · NZ First · Minister for Rail
Answer
Rule 12 was used. Valid exemptions from open advertising (Rule 12) are set out in Appendix 2 of the Rules, which sets out clear circumstances in which a procurement may be exempt from open advertising. Ferry Holdings have applied those provisions on occasion where the facts and circumstances met the grounds listed.
