Answer

I am advised that where a sentencing exception under s65AI of the Land Transport Act 1998 (the Act) was imposed and is no longer relevant, a person may apply to the Court under s100C of the Act for an alcohol interlock sentence in its place. Section 100C was implemented on 1 July 2018. There have been 28 applications to impose an alcohol interlock sentence under s100C of the Act granted since 1 July 2018.
