Further to reply 35743 (2026), can the Minister confirm whether the statement that no agreements under section 17 of the Public Works Act 1981 have been deemed entered into as a result of a section 185 order in the last 10 years is accurate, after the Environment Court's consent order of 18 May 2026 in Stanbridge v New Zealand Transport Agency (ENV-2024-AKL-234), which the Court found gave rise to a deemed section 17 agreement under section 185(5) and (6) of the Resource Management Act 1991?

Answer
NZTA has confirmed that no agreements have been entered into in the last 10 years as a result of an order made under s185 of the RMA. One agreement is currently with the landowner for signing and once this is done the agreement will go to LINZ for execution.
