Answer

Requests for change of status are routine matters for the Attorney-General’s decision required by section 31 of the Criminal Procedure (Mentally Impaired Persons) Act 2003. They relate to people who are held as special patients or special care recipients after being found unfit to stand trial on criminal charges. Briefings regarding the change of legal status of a person are about an individual’s circumstances and involve significant privacy concerns. The contents of the ‘Request for change of legal status, 31 July 2026’ briefing are privileged. I made a decision in respect of this advice on 3 August 2026.
