Which material risks in the Warkworth to Te Hana project are retained by NZTA or the Crown rather than transferred to the Northway consortium under the Project Agreement signed in July 2026, if any, what dollar value was assigned to each retained risk in the Public Sector Comparator and PPP evaluation, and what is the total value of retained risk in each case?

Answer
I refer the Member to my response to Written Parliamentary Question 34436 (2026). NZTA retains or shares a range of risks that cannot be efficiently be passed to the consortium. These include some change in law risks and uninsurable events. Annex 4 of Appendix 3 of the release Cabinet referred to in Written Parliamentary Question 34438 (2026) details the risk sharing framework. Compensation Extension Events (where NZTA is liable for increased time and costs) are a mixture of those typically included in NZ PPPs and those of a project specific nature. The link of these risks to the PSC and evaluation is commercially sensitive.
