Answer

I am advised that the Performance Regime is a primary financial incentive mechanism in the Project Agreement, aligning the Contractor’s economic outcomes with safe, available and high-performing delivery across the 25-year operational period during which the Unitary Charge payments are made from NZTA to the Contractor. The full KPI regime and its calibration is commercially sensitive. There is no cap on deductions for KPIs and the availability regime – the full unitary charge is at risk.
