Answer
I am advised that potential overseas pension entitlement is generally identified through information provided during the application process for New Zealand Superannuation. As part of the application, applicants must complete the overseas residence section, detailing any countries where they have been born, lived, or worked. This information is recorded in the Ministry of Social Development systems. Under section 173 of the Social Security Act 2018, applicants are required to take reasonable steps to obtain any overseas benefit or pension to which they, or their dependent, may be entitled. The applicant’s spouse or partner is also required to take reasonable steps to obtain their overseas pension entitlement. This information is automatically shared with MSD’s specialist International Services team which uses the information provided to identify clients who may have an entitlement to an overseas pension or benefit. In most cases, potential eligibility for an overseas pension is determined based on the applicant's declared overseas residence and employment history, together with any further assessment undertaken by International Services regarding possible overseas pension entitlements. Failure to take all reasonable steps to test their entitlement to an overseas pension or their New Zealand benefit or pension could be suspended or cancelled.
