Answer

EECA: There has been one financial settlement with a total cost of $56,681 during the 2023/24 Financial Year. EA: Please refer to the response to written parliamentary question 26038 (2026) for the number of settlement agreements and their cost. These settlement agreements all included a confidentiality clause. No other non-disclosure agreements (NDA) or confidentiality clauses have been entered into since 27 November 2023. We note that we have not interpreted NDAs or confidentiality clauses as including confidentiality agreements signed with other public service agencies, statutory entities, gas industry body, and overseas regulators as permitted under section 47A of the Electricity Act for the purposes of sharing information and documents, or signed by staff for the purpose of maintaining confidentiality when undertaking highly confidential or sensitive work (for example, in the initial stages of the Energy Competition Taskforce work). MBIE: I refer the Member to the Minister for Economic Growth’s answer to written parliamentary question 26231 (2026).
