  • Can he confirm that under the proposed property management regime a person whose registration was previously cancelled through disciplinary procedures may be re-registered if the Registrar is "satisfied that exceptional circumstances justify re-registration"; if so, who will define what constitutes exceptional circumstances, and will that definition be set in primary legislation?

Answer

The Registrar will have the discretion to decide what constitutes “exceptional circumstances” for re-registration. Whether a definition will be contained in the Bill is the sort of matter that will be considered further during the process of drafting the Bill.
